The Malaysian Anti-Corruption Commission's (MACC) reluctance to probe 1MDB because it is currently a police matter has cast doubts on their independence, said Bukit Gelugor MP Ramkarpal Singh.
In a statement today, Ramkarpal said that MACC chief Dzulkifli Ahmad's recent statement on this showed that the commission could be influenced by other government agencies.
"This is a most dangerous precedent which must be corrected immediately as failure to do so will certainly cast serious doubts on the independence of the MACC," he said.
Dzulkifli said the MACC will leave investigations related to 1MDB to police to avoid an overlap.
Police had on April 12 completed its investigation into 1MDB and passed its investigation papers to the Attorney-General's Chambers to decide if prosecutions will be made.
This, said Ramkarpal, was an indirect admission on the MACC's part that they are withholding investigations, not because of a lack of evidence, but because he has been influenced by other government agencies.
1MDB is in the spotlight once again following the US Department of Justice's (DOJ) third court civil forfeiture action to seize more than US$1 billion worth of assets in the US, which is said was purchased using funds syphoned from 1MDB.
1MDB denies any wrongdoing
Dzulkifli also said the anti-graft body is unlikely to get involved because the US DOJ did not contact the MACC for assistance, a position which Ramkarpal said was invalid.
"Dzulkifli should know that it matters not if the DOJ has contacted the MACC in investigations into 1MDB.
"What matters is whether there is a reason to investigate 1MDB in the first place," Ramkarpal said.
In its latest filing on Thursday, the DOJ detailed how Jho Low, a thirty-something tycoon from Penang who played a role in setting up 1MDB, allegedly syphoned hundreds of millions from 1MDB.
He allegedly used the funds to buy luxury properties, a yacht, a jet, paintings, and jewellery, including a 22-carat diamond necklace for the wife of an unnamed "Malaysian Official 1".
Minister in the Prime Minister's Department Abdul Rahman Dahlan last year identified PM Najib Abdul Razak as "MO1".
Lawyers for Najib's wife, Rosmah Mansor issued a statement warning all against slandering Rosmah while Low claimed the DOJ's lawsuit is baseless.
Also named in the DOJ's lawsuit is Najib's stepson Riza Aziz.
Najib said he has no knowledge of money laundering involving 1MDB, and denied all allegations of corruption.- Mkini
